History
James R. Flandreau, Esquire concentrates on helping injured workers receive the workers' compensation benefits to which they are entitled. He works with his clients from the very beginning - sometimes even before any litigation is pending. This allows him to ensure that the appropriate groundwork is laid to establish a client's entitlement to benefits, and to protect the benefits from being cut off before the client has fully recovered from the injury. Because he has litigated workers' compensation cases for over 20 years, Mr. Flandreau is well known and respected by both the Workers' Compensation Judges and by the other attorneys who practice in this area.
Social Security disability has been a natural outgrowth of his workers' compensation practice. When the injuries suffered by his clients are so severe that they may qualify for Social Security disability benefits, Mr. Flandreau represents them during the application process and any appeals that may follow.
Clients
Mr. Flandreau concentrates on representing injured workers. His clients include people who whose work injuries caused herniated disks in their neck or back, head injuries, brain injuries and partial or complete paralysis. Depending upon the injury, he helps them receive the monies to which they are entitled for:
• their lost wages
• scars on their face or neck
• the loss, or loss of use, of a body part.
He also fights to get them the medical treatment they need and, in catastrophic cases, the necessary modifications to their home and car.
The many cases that he has won or successfully settled include:
• A truck driver left paralyzed by a broken neck. His settlement included payment for both his lost earnings and the loss of use of his arms and legs. The employer continues to pay for the necessary medical treatment.
• An auto mechanic who returned to work at lower earnings after he suffered a rotator cuff injury. The employer had refused to pay for his lost earnings and instead tried to cut off his benefits entirely.
• A forklift operator who fractured a vertebra when the platform on which he was seated fell approximately 25' to the floor.
• An employee of a nut roasting company who suffered a shoulder girdle sprain and brachial plexopathy while cleaning a roasting kettle.
